Gone are the days when a simple handshake could consolidate a work agreement between a buyer and his real estate agent. Instead of a handshake, buyers` brokers present buyers with a document called the Buyer Broker Agreement – and you may not know what it is! A reference is the best way to find an agent. In fact, many buyers from family, friends or colleagues are designated as buyers` representatives. But buyers who move to a new territory generally do not have this option. A broker will sit down with you to find out how much home you can afford and what requirements the house should meet. You will consult the lists of real estate in your desired area and schedule appointments to show you houses that best meet your criteria. They will give you a general overview of the neighborhoods where you shop for houses and will answer any questions you may have along the way. If another party pays a commission to the broker, that obligation is waived. In addition, the buyer is usually able to buy a home through another broker as long as that home has not been proposed by the previous broker. As a general rule, these agreements can only be revoked for certain reasons.
Ask any broker from a buyer who has been practicing real estate for some time, and you will hear sad stories from those who wished to have signed a buyer for a buyer`s brokerage contract, sometimes called a buyer`s representation agreement. When the buyer finally decided to make an offer, he finally wrote it with another agent, so that the agent was not paid. The length of your buyer brokerage contract is one of the first things specified in the contract. During this period, you are contractually obliged to respect the agreement for this period. The main advantage for a home buyer to use an exclusive right to represent the contract is the fact that the buyer`s representative should focus on the buyer and work carefully to find that buyer as a home. Buyers who work under other agreements tell their agent that he doesn`t have to work very hard for them because they may not use that agent to buy a home. Non-exclusive rights to representation contracts stipulate that the buyer will compensate the broker if the buyer buys a home that his agent presents to them. However, if the seller agrees to pay a commission to the buyer`s agency, they are delighted.
Under this contract, the buyer can also buy a house from another broker until his or her original broker has offered it. In its « Shopping for a Home Loan » brochure, the U.S. Department of Housing and Urban Development (HUD) Settlement Cost Booklet  (page 6) recommends that buyers rent a home from an exclusive home agent. They will make an appointment with the sellers to show houses, and they will drive their buyers from one quarter to the next and sometimes browse up to 10 houses a day. They`re going to explore comparable sales. Real estate companies in the U.S. can represent both buyers and sellers in the same transaction, and if they represent both, you reap profits from both the seller and the buyer of the transaction. While some states, at the request of broker groups, have created different forms of dual agency to allow a company and, in some cases, a single agent, to represent both parties, other states have continued to consider these practices to be illegal.
